Chile to expedite permitting

Chile’s Congress passed amendments to a bill to simplify and speed up investment project permitting for permits that are not part of the environmental assessment system. Economy minister Nicolás Grau said “one of the main reasons why sector permits take so long is because services are backed up”. The new legislation should reduce permitting time by 30-70%. The initiative includes the creation of a single digital one-stop shop platform called SUPER to submit and track permit applications across agencies across ~16 ministries and over 400 different sectoral permits.

The amendments include the use of formal deadlines for approvals, and administrative silence rules that grant automatic approval if the authorities do not respond within the mandated time. A key change is the ability to apply for multiple permits in parallel rather than in series as has historically been the case, and the use of sworn declarations for low-impact projects rather than full processes. Some changes will take immediate effect upon presidential signature, while others will roll out over the next year. A reform of the Environmental Impact Assessment System (SEIA) to reduce evaluation times is ongoing. It aims to reduce permitting times by 30%.

Chile has a presidential election on November 16.
